    Electronic Notarizations - Pioneering the Future

    eNotary or eNotarization has been a buzzword floating around for the past few years. As with any innovative new idea, such as the automobile, the television, compact discs, DVDs, it takes some time for these new systems to be implemented. eNotarization creates many more problems in an attempt to solve other problems. Several states have adopted eNotary laws such as North Carolina, Pennsylvania, Florida and California.     The Pennsylvania Department of State has taken new steps to make eNotarization more accessible to Pennsylvania’s approximately 80,000 notaries public:

    1. The Department will begin the transition to a multi-vendor system, to increase the opportunities and choices for Pennsylvania notaries to electronically notarize electronic documents.
    2. The Department will eliminate the $40.00 fee for electronic notarization applications.
    3. It is hoped that the notaries will now see that some of the barriers have been lifted that have prevented notaries from taking the step into the future.

    New California Cell Phone Law

    As of July 1, 2008, you can no longer talk on a cell phone in California while driving, unless you use a hands-free device or in an emergency situation. This law was designed to help keep drivers from taking their eyes off the road while searching for their cell phone or text messaging on the freeway. If you are a mobile notary, be sure that you have a hands-free device so that you do not miss any work. The DMV has put together a short video outlining this new law.     California Notary Trivia Question

    You receive a call from a title company to have loan documents notarized. They agree to pay you $150 for the package including travel fees and eDocs. You meet the borrowers at their home. While filling out the journal entries, you come to the Fees box.

    If you are notarizing 4 documents, each with 2 signers, what should you put for the fee in the eight journal entries?

    A. Leave the fee box blank since the signers are not paying the notary directly.

    B. Put "$150" in the first journal entry and put "N/C" or "$0" in the remaining 7 entries.

    C. Put "$0" or "N/C" in all entries and indicate in the notes that it was part of a loan package.

    D. Put "$10" in each entry since that is the maximum that you can charge for notary service.

    E. Take the $150 and subtract travel fees and eDoc fees and divide that number by the number of notarized signatures and put that number in each of the 8 entries.

    The best answers are probably C. or D. Since loan signing fees are paid as a package deal, you are essentially performing notary service for free. Sometimes if you were to multiply all the signatures by $10, the amount you are receiving from the loan signing company or the title company would be less than if you charged the maximum for each signature notarized. It is important to remember to be consistent. If you do not charge someone, why didn't you charge? Be sure to put in the notes why the fee was "$0."     California Notary Trivia Question

    Someone brings you a Quit Claim Deed to be notarized. The Quit Claim Deed has already been signed and the person that brought it to you is not the signer. They tell you that the signer was in another country and couldn't appear before the notary. They say that they saw the person sign it and that they want you to use the Proof of Execution By Subscribing Witness. What should the notary do?

    A. Refuse to perform notary service because the signer could not appear.

    B. Attach a Subscribing Witness loose certificate and notarize the document and have the witness complete the journal entry.

    C. Refuse to perform service since a thumbprint in the journal is required.

    D. Perform notary service as usual and require the witnes to sign the journal. No loose certificates are allowed on recordable documents.

    The answer is C. Even though a Proof of Execution is allowed for acknowledgments, since documents involving transfer of real property require a thumbprint in the journal by the signer, you must refuse service on this document unless the signer personally appears before you.

    California Notary Trivia Question

    You just got a call from a title company and they want you to notarize loan documents tomorrow. You inform them that you cannot find your notary stamp, but you still have your embosser. The title company is located in Washington D.C., so they say it is fine to just emboss the documents. Which of the following is true?

    A. Since the document is going to Washington D.C., using the embosser only is fine.

    B. You can use the embosser as long as you make the raised edges photographically reproducible.

    C. A California notary must stamp and emboss every document.

    D. A California notary cannot notarize out of state documents.

    E. The notary must immediately notify the Secretary of State that the notary stamp is missing.

    The answer is both B and E. The elements of a seal must be photographically reproducible, notary name, county where commissioned, expiration date, commission number and 100% clear and legible with a milled or serrated border. If you do not know where ANY of your seals are, you must immediately notify the Secretary of State by certified mail that you have lost your seal. If it was stolen, include a copy of the police report. If you would like a new Certificate of Authorization to Manufacture Notary Public Seals, you must specifically request that as well.

    The Secretary of State sends you a notice in the mail and it is returned to them with a message the you are no longer at that address. What can happen in this scenario?

    A. The Secretary of State can fine you up to $500.

    E. There is no fine if you do not inform the Secretary of State that you changed your address.

    The answer is A. The Secretary of State could fine you up to $500 for not changing your BUSINESS or RESIDENTIAL address within 30 days of moving. If you are moving or have moved recently, be sure to send in your Address Change Form.     Jurat and Acknowlegment Form Clarification

    The 2007 California State Notary Handbook is not out yet, but Golden State Notary has acquired some of the clarification updates. One of the most important is in regards to jurat and acknowledgment forms. If you have a form with check boxes in the actual notarial wording, you cannot use that form any more.     Rejected Documents?

    Have you ever had your document rejected by the County Recorder? This can be embarrasing and time consuming for you and your client. Many notaries have had documents sent back because they did not put "Notary Public" after their name. When you are filling out the notarial certificate and it says "before me_____________________", you must put "Your Name, Notary Public" in the blank. Failing to put "Notary Public" could cause your document to be rejected.

Unfortunately, the email server did not fully transfer over, so we lost many of the emails that were sent through forms on the website from June 30 - July 10. If you used the Contact Us or Proof of Completion Mail Request forms, we probably did not receive your emails. We were able to recover most of the data from the Loan Signing Agent course completions. If we have not already responded to your requests, please resubmit them. Sorry for the inconvenience.

    Certified Copies

    California notaries are only allowed to certify copies of their own journal and powers of attorney. What should you do then if someone needs a passport, marriage license, etc. notarized? You put the liability on the person, not on you. Golden State Notary now offers a free Affidavit of Document Custodian form. Other companies charge for similar items. This is only available to GSN members. Please login to your account and you will find this valuable resource under the "Documents" heading.

    NotaryCA.com will soon be a subscription site. It has been free for nearly 18 months! The operating and advertising costs are too high to keep it completely free.     Rejected Documents?

    We have been receiving reports that some county clerks are rejecting documents if the notary does not put "Notary Public" after his/her name on acknowledgments. Be sure that when the form says before me________, you would put "Your Name, Notary Public" in the blank. Failure to do so may cause your client's document(s) to be rejected.

    Update Your Information

    As Golden State Notary is expanding to a nationwide platform, we want to make sure we do not clutter inboxes with emails that do not pertain to the recipient. In order to do so, we need to make sure we have the most accurate information. We have some users where all the information we have is an email address.     Caliifornia Notary Seminars, Supplies and ServicesTest Results, Supplies and Bonds

    We have been getting several phone calls about test results, notary supplies and bonds. It seems there is confusion about all three.

    Test Results

    Golden State Notary does not have the results of your test. CPS is the only place where you can get your test results. They will be mailed to you within 2 weeks (8-10 business days) of your test date. They may also email you instructions to get your test results online. Do not call us to get your test results. If it has been longer than 10 business days since you took the exam or for any other questions regarding the notary exam, you may call CPS at (916) 263-3520.

    Notary Bonds

    If you ordered a bond from us as a part of your package, we cannot send it to you until we receive your Certificate of Authorization to Manufacture Notary Public Seals. This document is mailed to you with your commission paperwork. You can fax this document to (619) 588-5117 for the fastest possible delivery of your bond. You must have the bond to file with the county clerk. It will be delivered via DHL so we will need a physical address.

    Notary Supplies

    To get your stamp, embosser and ID Checking Guide, we will need you to send your ORIGINAL Certificate of Authorization to Manufacture Notary Public Seals to:

    New Notary Journal

    We received our shipment of the new notary journals on Friday afternoon. The first batch went out yesterday.     Are you 2006 Compliant?

    As of tomorrow, January 1, 2006, all California notaries are required to use specific, exact wording for acknowledgments that will be recorded in California. This does not apply to documents that will be recorded in other states or other countries. Be sure to check the wording on the acknowledgment instructions to exactly match this:

    Golden State Notary Corporate Headquarters is Moving

    GSN Corporate Headquarters

    Golden State Notary will be moving its corporate headquarters from El Cajon, CA to Franklin, TN on Friday, November 18, 2005. We will have limited telephone and email customer support from Friday, November 18, 2005 until after the Thanksgiving holiday. We will be checking and responding to voice mails and emails periodically throughout the moving process. On Friday, November 18, 2005, our billing address will change from 1283 East Main Street, Suite 210, El Cajon, CA 92021 to our new physical/billing address:

    NEW LAWS THAT WILL AFFECT NOTARIES PUBLIC BEGINNING JANUARY 1, 2006

    On September 22, 2005, the Governor signed AB 361 (Statutes of 2005, Chapter 295). The new law makes several significant changes in current notarial law and takes effect January 1, 2006 . The text of the new law can be found here: ab_361_bill.pdf.

    The key changes effective January 1, 2006, are:

    • Civil Code § 1189 (Amendment to Section) - Certificate of Acknowledgment - Under the new law, the California certificate of acknowledgment must be in the form set forth in the statute, rather than "substantially" in the form set forth in the statute. The form set forth in the statute did not change, but variations in the California form are no longer permitted. (The law regarding acknowledgments to be used with documents to be filed in other states has not changed (Civil Code § 1189(c)). Effective January 1, 2006, if a document contains a suggested "certificate of acknowledgment," the certificate may be used only if it is exactly the same as the statutory wording. If it is not, then a loose certificate of acknowledgment with the statutory wording must be used.

    • Government Code § 8214.8 (New Section) - Criminal Convictions/Court Revocation of Commission - If a notary public is convicted of a crime related to notarial misconduct, including the false completion of a notarial certificate (Government Code § 6203), or of any felony, the court must revoke the notary public's commission and require the notary public to surrender to the court the notary seal. The court will then forward the notary public's seal to the Secretary of State.
    • Government Code § 8225 (Amendment to Section) - Notarial Journal - The new law makes it clear that a person who solicits, coerces, or influences a notary public to improperly maintain the notary public's journal is guilty of a misdemeanor.
    • Government Code § 8228.1 (New Section) - Notarial Journal/Seal - The new law makes a notary public guilty of a misdemeanor if the notary public:
      • Willfully fails to properly maintain his or her notarial journal; OR
      • Willfully fails to notify the Secretary of State if his or her notarial journal is lost, stolen, rendered unusable or surrendered to a peace officer; OR
      • Willfully fails to permit a lawful inspection or copying of his or her notarial journal; OR
      • Willfully fails to keep his or her notarial seal under direct and exclusive control; OR
      • Willfully surrenders his or her notarial seal to any person not authorized to possess it.

    5. Penal Code § 470 (Amendment to Section) - False Acknowledgments/Forgery - The new law makes a notary public guilty of forgery if he or she issues an acknowledgment knowing it to be false. A person who falsifies the acknowledgment of a notary public is also guilty of forgery. Forgery is punishable by imprisonment in the state prison, or by imprisonment in the county jail for not more than one year. (False certification by a notary public is also a misdemeanor pursuant to Government Code § 6203.)

    New Locations Added

    Renewing Notaries

    The Secretary of State recommends that you take your notary test 4-6 months before your commission expires. This will ensure that you will not have a lapse in your commission. If your commission expires in December 2005 - February 2006 or earlier, make plans to take the mandatory notary seminar and State Exam this summer.

    Private Seminars

    Information Update

    On June 17, 2005, Golden State Notary was approved as a notary education vendor in California. All seminars and online courses from this point on will include a certificate of completion that must be attached to applications of new and renewing notaries whose commissions will be issued on or after July 1, 2005.

    We realize this has been a hectic time for notaries and vendors alike, but we just ask that you be patient as we make the best out of this situation.

    If you have:

    (1) Taken our course and received a deficiency letter from the State

    -or-

    (2) Taken our course and are a July or later renewal

    You will have two options:

    (1) Take our online seminar (once the course becomes available) free of charge

    -or-

    (2) Take our live seminar again free of charge.

    There are several people who fall into these categories, so please be patient as we attempt to accommodate them all. If you would like the online course, we will email you again once it is available, then you will call our office and we can give you immediate access. If you would like to attend the live seminar again, you can show up at the door for the one on Monday, June 20 in Burbank since our offices are closed on Saturday and Sunday. For all others, please call us and let us know which one you would like to attend.

    If you have not taken our course yet and are a July renewal, we will offer our online course for half price (normally $79). This will be the most convenient way for you to qualify for this new requirement. All that we ask is that you tell people interested in becoming or renewing their notary commission about this online course. We will email you as soon as this course is available

    Also, CPS has decided that they will now allow us to have proctors come to the seminar sites to give the state exam immediately following the seminar once again. There is an indefinite time frame as to how long they will offer this service, while they inquire on how to improve the system. Most, if not all, of our July seminars will have the state exam immediately following. We will email you again when this information becomes more clear.
